EMINENT REPORT REMINDER FOR TEXAS SCHOOL DISTRICTS

EMINENT DOMAIN REPORT DUE FEBRUARY 1, 2024

In case you have forgotten since last year, Texas Government Code Sections 2206.15 – 2206.157 require Texas school districts to submit an annual eminent domain report to the Comptroller’s office. Failure to timely file the report could result in a civil penalty if a district fails to submit the report after written notice of its failure to timely do so.

For required governmental reporting, the Comptroller has made the process as painless as possible by developing an electronic reporting form and system, which can be found at

https://comptroller.texas.gov/transparency/local/eminent-domain.

An entity must submit the Eminent Domain Report with required information in a form and in the manner prescribed by the Comptroller not later than February 1 of each year Government Code §2206.154.

Most, if not all, of you have probably not used eminent domain in the past year. If so, the report should be fairly easy to fill out and identical to last year’s form. However, if you have used your eminent domain power in the last year, additional reporting will be required. To complete the form, you will need the following identification numbers:

The Eminent Domain ID number.

The Texas Taxpayer ID number.

An entity that does not submit the required Eminent domain Report may be subject to a maximum penalty of $2,000 for each reporting year.
